Broken CD case with the disc inside?

1 of my boxes of CD does not close properly and if u just tilt it opens. Will that damage the CD inside, in any form or as long as the disk is securely in the event that you do not care what the top half of the box does not mean that because the upper half of the box never touches the disk when you close the case as the record I should not get hurt if the CD is safely?
